UNLAWFUL COMMENCEMENT OR CONTINUATION OF ACTIVITIES IDENTIFIED IN TERMS OF THE ENVIRONMENTAL IMPACT ASSESSMENT REGULATIONS IN TERMS OF SECTION 24G OF THE NATIONAL ENVIRONMENTAL MANAGEMENT ACT, 1998 (ACT NO. 107 OF 1998, AS AMENDED)
- Notice is given, in terms of Section 24(G) read with section 24(F) of the National Environmental Management Act, 1998 (Act No. 107 of 1998) (as amended); and
- Regulation 43(1) of the regulations published in Government Notice No. R982 (as amended) issued in terms of Section 24(5) of the National Environmental Management Act, 1998 (Act No. 107 of 1998); and
- Section 40 and 41 of the National Water Act, 1998 (Act No. 36 of 1998), as amended; and
- the Regulations Regarding the Procedural Requirements for Water Use Licence Applications and Appeals (No. R. 267, published 24 March 2017);
that the Gauteng Department of Agriculture and Rural Development:
- has received and is considering an application for rectification by HarvestFresh Farms (Pty) Ltd in terms of Sections 24(G) and 24(F) of the National Environmental Management Act, 1998 (Act No. 107 of 1998, as amended);
- For the unlawful and illegal commencement of activities listed in terms of the Environmental Impact Assessment Regulations under the sub-regulations of Government Notice R983 of 04 December 2014 promulgated in terms of sections 24 and 44 of the NEMA, as amended.
The listed activity contravened is:
Activity 27: “The clearance of an area of 1 ha or more, but less than 20 ha of indigenous vegetation except where such clearance of indigenous vegetation is required for:
- The undertaking of linear activities, or
- Maintenance purposes undertaken in accordance with a maintenance management plan” of R983 of 4 December 2014, as amended, issued in terms of the National Environmental Management Act, 1998 (Act No. 107 of 1998).
2.4 ha of indigenous vegetation were unlawfully and illegally cleared between July 2016 and March 2017 without environmental authorization; an S24G process is now required to obtain environmental authorization.
Application for an Integrated Water Use License (IWULA) will be submitted to the Department of Water and Sanitation for the following water uses in terms of the National Water Act, 1998 (Act No. 36 of 1998):
- S21 (a) - taking water from a water resource;
- S21 (e) - engaging in a controlled activity identified as such in section 37(1);
- S21 (f) - discharging waste or water containing waste into a water resource through a pipe, canal, sewer, sea outfall or other conduit;
- S21 (g) - disposing of waste in a manner which may detrimentally impact on a water resource;
